HC Orders TNSTC to Pay Penal Interest for Delayed Payment of Retirement Benefits

The Madurai Bench of Madras High Court, on 03 Dec 2019, has ordered The Tamil Nadu State Transport Corporation (Kumbakonam) Ltd. "to pay the penal interest at the rate of 6% per annum on the belated payment of the retirement benefits for the period from the date of the retirement till the date of actual disbursement, as expeditiously as possible and in any event, not before the expiry of three months from the date of receipt of a copy of this order."

HC Orders Police Selection Board (USRB) to Share CCTV Footage

The Madurai Bench of Madras High Court on 03.12.2019 has passed an Order, observing that it was well within the provisions of RTI for the petitioner to seek "for a view of CCTV footage recorded during the selection process."

The Petitioner is of the view that she has qualified herself in the 200 meters running, liberty is granted to her to file a fresh Writ Petition.

The Petitioner has prayed to "direct the respondents to allow the Petitioner to participate in the Certificate Verification for the post of Grade-II Constable, Grade-II
Jail Wardens and Fireman in the Tamil Nadu Uniformed Services
Recruitment Board, 2019."

The court has granted her to file a fresh Writ Petitioner, if after obtaining such CCTV footage, the Petitioner was of the view of having qualified in the 200 meters running, as contended.

Sale on SARFAESI Act subject to Stamp Duty ; HC

The full bench at The High Court of Judicature at Madras, on 05.08.2019, rendered an Order wherein it was of the view that "the Sale Certificate issued by
the Authorized Officer of the bank is liable for stamp duty under Article 18-C read with Article 23 of Schedule 1 of the Indian Stamp Act.

The Order further added that, "In the
event of under-valuation of the property, which is the subject matter of the Sale Certificate, the Registering Officer is entitled to proceed in accordance with Section 47-A of the Indian Stamp Act."

The Learned Single Judge has earlier referred this case to the Full Bench, since there were Since two conflicting judgments rendered by different Division Benches.

November 2019

* Observance of the “National Legal Services Day” on 9th November of every
year. Suitable Programmes to be organized by conducting Legal literacy and
Legal Awareness Camps across the State.

* To Organise Legal Literacy and legal awareness camps across the state of
Tamil Nadu about NALSA (Legal Services to the Victims of Drug Abuse and
Eradication of Drug Menace) Scheme 2015
Observance of “Children’s Day” on 14th November of every year Suitable
Programmes to be organized involving children belonging to marginalized
sections of the society.

* Observance of “Law Day” on 26th November of every year suitable
programmes arranged for panel lawyers to help weaker section of the society.

* To Conduct Special Legal Literacy classes for women in Schools and
colleges on various Rights.

* Organizing Special programmes on “Juvenile Justice and Child rights”
across the State in association with Department of Child Welfare.

* To Organize Medical Camp in association with Health Department for
needy persons.

* “Induction Programme for PLV” shall be conducted to explain Para Legal
Volunteers how to approach the people with regard to render legal services at
the door step by selecting resource persons from panel lawyers.

* To organize “street play” across the State to create awareness among the
public about protection of children and women.

Writ Petition praying to direct the respondent to reinstate the petitioner into service with
continuity of service and all other attendant benefits.

The court observed that "prolonged
suspension is unreasonable and without any justification."

Accordingly the court directed the respondent "to reinstate
the petitioner in any non-sensitive post where the Department feels
that the petitioner can be accommodated as per the the Hon'ble Supreme Court judgment in Ajay Kumar
Choudhary v. Union of India [(2015) 7 SCC 291]
