Highest Civilian Award Announced

Government of India has instituted the highest civilian award in the field of contribution to the unity and
integrity of India, in the name of Sardar Vallabhbhai Patel.
A notification instituting the Sardar Patel NationalUnity Award was issued by Ministry of Home Affairs on 20th September, 2019.

SC: Acting CJ Not Entitled for Pensionary Benefits As Applicable to CJ

The Supreme Court of India in Writ Petition (C) No. 300 of 2016, has delivered it's Judgment stating that the petitioner, a Retired Acting Chief Justice of an High Court is not entitled to pensionary benefits, applicable to a retired Chief Justice of a
High Court.

SC Urges Centre and MCI to frame Policy on Compulsory Service for Doctors

The Supreme Court of India has suggested to the Union of India and the Medical Council of India, that suitable steps be taken to take necessary steps "to have a uniform policy regarding the compulsory serviceto be rendered by the Doctors who are trained in government Institutions."

"Doctors who have executed compulsory
bonds shall be bound by the conditions contained therein", the Supreme Court has stated.

THE SUPREME COURT OF INDIA in it's Judgment Dated 09 August 2009 wrt
CIVIL ORIGINAL/APPELLATE JURISDICTION
WRIT PETITION (CIVIL) NO. 43 OF 2019,
challenging the constitutional validity of amendments made to the Insolvency and Bankruptcy Code, 2016, has held that,

"The Amendment Act to the Code does not infringe Articles
14, 19(1)(g) read with Article 19(6), or 300-A of the Constitution of India."

The court has also stated that, in case of conflict "the Code will prevail over the Real Estate (Regulation and Development) Act, 2016 (RERA).

The amendments made to the Insolvency and Bankruptcy Code,  "deem allottees of real estate projects to be “financial creditors” so that they may trigger the Code, under Section 7 thereof, against the real estate developer. In addition, being financial creditors, they are entitled to be represented in the Committee of Creditors by authorised representatives."

THE MADURAI BENCH OF MADRAS HIGH COURT on 06.02.2015 in Writ Petition (MD) No.8250 of 2008 and M.P.(MD)No.1 of 2018 has concluded that, "that the
requirement is to pay only one set of fee but, the collecting agency for such fee is
now the Registration Office. No second set of fee is required to be paid.

measure with the assistance of Social Welfare Department.

* To organise Legal Literacy Programme for NALSA (Legal Services to Senior Citizens) Scheme, 2016

* To Depute Panel advocate to attend “Grama Sabha Assembly” on 2nd
October every year for providing legal assistance to the public on the occasion of “Gandhi Jayanthi”.

* Observance of “World Mental Health Day” on 10th October every year for the persons suffering from mental disabilities, Publicity for the “rights of Mentally challenged people” and their entitlements to free legal services
through hoardings, pamphlets etc.

* “Seminar for Judicial Officers” in relation with Juvenile Justice Act 2015, Domestic Violence Act 2005, Rights of women under the Hindu Marriage Act, Christian Marriage Act, Muslim Women’s Protection Act and Special Marriage Act in association with Social Welfare Department and NGO’s

* To Organize Legal Literacy and Legal Awareness Camps across the State of Tamil Nadu relating to NALSA (Legal Services to the mentally ill and Mentally Disabled persons) Schemes 2015.

* To Organise the “Legal Literacy Classes” or “Legal Awareness Programmes” for the under trial prisoners about the rights of prisoners in all Jails across the State.

* On observance of “Anti Poverty Day” on 17th October, to organise a programme for “Effective Implementation of Poverty Alleviation Schemes, 2015”.

* To organise live programme for Legal Literacy and Awareness to the public through TV/Radio/Community Radio through Question & Answer.
